Hey all,

I’m just wondering if anyone in the group has had any luck fighting or dismissing a speeding ticket based on the officer pacing the vehicle?  My son (18) was pulled over for this and given a ticket and honestly doesn’t think he was going the speed the officer said he was.  He said it was 73 in a 50 zone but when my son asked how he came to that conclusion and if he got him on radar, the officer told him that he did not but was pacing him.  So he actually wrote the ticket for 5 mph over instead of 23 over but the ticket noted “73 in 50.”  I’ve read online if you elect to go to court and the officer shows up (with my luck he will) that you can request documentation on if the patrol car’s speedometer was calibrated in last 6 month and also ask about pacing distance and that over 30 yards has a high margin of error. Just wondering if anyone has had any success with this or any tips?

Also, we are not sure if he has the option of paying ticket and electing traffic school course to avoid the points on his license because it occurred 11 days shy of his first ticket, which he completed traffic school on.  That was 9/14/18 and this year’s ticket was on 9/3/19.  The courthouse said he may still be able to attend school because he made that election in writing on 9/24/18, so we could potentially make that request after 9/24/19 and still do the traffic school but the lady wasn’t sure and that I should contact the DMV to ask them.  No luck getting an answer or reaching them yet.  My car insurance is already $500 per month and I certainly don’t want it to go any higher.

Any suggestions are appreciated!  Thank you.

Ticket Clinic? Pay the fine and no points? It's been years since I have used them. You could also ask Dave Paz.

I would go to doing it the new way, since cars and officers now have cameras, have them prove it on video. I’ll go that route first, and see what happens. The officer will show up in court because his court dates are all scheduled at the same time.

I think one of the main reasons people hate the fucking police is because of the bandits of the road aka Highway Patrol and Ticket cops.

When your car breaks down you sure as hell won't see them. Drunk driver weaving all over the road? Nope.. nowhwere in sight. However when it gets close to the end of the month and quotas are due you bet your ass you'll see them.. hiding in bushes like thieves waiting to pounce and rob you.

Anyway it's not about public safety it's about money. The cops are basically salesman for the 'man'.

Best way to deal with it is as giest said, ticketclinic.com. You'll pay I think $79? (or something like that) and their lawyer will deal with it. The outcome will most likely be they waive the ticket in lieu of 'court costs' which will be just about the same cost as the ticket.. so the machine gets what it wants but at least you don't have to deal with a BS traffic school or points.

Also as you've probably already realized the DMV is incompetent and very, very poorly run so getting a straight answer out of them (or a correct one) is unlikely. Just let the lawyers deal with it, that's the safest route.

Did this come off as bitter? lol

this. if his record is clean AND it's not a garbage county like marion county, ticket clinic will get the ticket dismissed.

don't pay the ticket outright.

don't think he'll win solo in court. huge waste of time even if he does win out.

just to note: i took a "To Wit: Burning Rear tires out at Stop Sign." ticket to court, with absolute proof he lied. i had a front wheel drive car. in court, i lost. the courts are part of the machine to get paid.

Dave is awesome as well. has given me golden advice in the past.

trust me. he's a lawyer. and i'm a fast driver. :P

Thanks for the info guys!  I appreciate it.

Update:  so I did call the people at ticket clinic.com.  They said their fee is $99.95 (plus whatever court costs are assessed if any...agent said it’s usually close to the cost of the ticket - $164.00) for Pasco County and they have a no points/no driving school money back guarantee BUT....only if the driver has NOT had a ticket in the last 3 years, which disqualifies him from that guarantee.

So I don’t know what to do know really.  Pay $100 plus another undetermined amount of court costs and roll the dice with these people?  Or just try to get him to attend the driving school again if I delay a bit towards the end of 30 days?

Where’s Dave Paz?  Help - suggestions please.

see, that's the issue. how does your county handle tickets?

broward county, ticket clinic, ticket gone. $89, no other costs. 4 tickets over the last 5 years. but 1 clerk fat fingered my entry, and deleted my driving history. thanks, lady. :)

palm beach county, ticket clinic, $89. ticket dismissed, but with court costs, $50. - 1 ticket last 5 years.

osceola county, ticket clinic, $99. got court costs and 3 points and $129. court costs from that crooked azz county, due to a speed trap FHP pooper that lied. 1 ticket, last 3 years. F*** that county.

i've done all the self-choice and court appointed driving schools by the time i was 25. damm near taught it 6 times by myself. i used to go to court a lot. a judge yelled at a cop for writing me a ticket. it was glorious.

it all varies court district to court district. i HAD 10+ pages on my driving history. all non-moving, but judges are always a smart azz when they unravel 10 pages off a dot matrix printer in front of a courtroom.  ;D

if he has a good record, a trip to court is sometimes worth doing. otherwise, traffic school it up. ticket clinic does tell people normally what to expect, because it is a cash cow after all for whatever county, and they usually give cookie cutter dispositions.

the officer told him that he did not but was pacing him.  So he actually wrote the ticket for 5 mph over instead of 23 over but the ticket noted “73 in 50.”
the officer wrote that to remind him, of the situation, if your son decided to go to court. the court won't like that he went to fight it.

PM dave with the thread, or the questions.  tktlwyr
